Though roadside safety checks, or checkpoints, occur year-round, holidays are a particular favorite time for law enforcement to conduct them. To a certain extent, this makes a lot of sense. People tend to imbibe a bit more alcohol during the holidays, and there is no more festive holiday season than the Thanksgiving, Christmas, Hanukkah, New Year’s Eve quadruple punch that occurs in the last 40 days of the year. As a precaution, one can assume that if a holiday weekend is approaching there is likely a checkpoint being conducted somewhere, possibly in your town.
Beginning in 1990, the Supreme Court upheld the legality of checkpoints on the premise that the underlying intrusion on a person’s rights was outweighed by the public and safety interests targeted by the checkpoints. This premise was held up in Illinois in the case of People v. Bartley, 486 N.E. 2d 880 , (see the full case here ). Essentially, as long as the officers conducting the roadside check were deprived of discretion, the court supported the legality of roadside checks.The types of things that removed officer discretion are the following: a pre-determined location chosen by supervisory law enforcement, a pre-established, systematic fashion of stopping vehicles, the existence of guidelines reviewed and published in advance. The level of intrusion and safety of the roadblock is also important. Valid roadblocks will give motorists sufficient notice, both in the fact that they will be conducted and that a driver is approaching the checkpoint. The intrusion to a motorist is also minimized if the checkpoint is well-lit and safe to enter.
As a consequence of the above guidelines, roadside checkpoints are usually publicized in the newspaper and also, these days, on official law enforcement websites. Often times the announcements will tell you exactly where and when the police will be conducting the safety check. While ferreting out intoxicated motorists is a primary concern for checkpoints, law enforcement can only request additional tests once they have probable cause that a driver may be intoxicated. And while there may be rules in place where the officers are supposed to only single out every third vehicle for a random check, if you give the officer another legitimate reason to make you pull over, such as a having a light out, or no seat belt, they can make you stop independent of the roadside check.
Despite the fact that you may be able to plan around a roadside safety check, Harter & Schottland recommends that you do not drink and drive. Officers often err on the side of caution and make an arrest when they smell the odor of alcohol, even if you are not intoxicated.
