One of the most obvious and serious aspects of a felony charge is the possibility of a prison sentence. In some cases a person may be eligible for probation, conditional discharge or periodic imprisonment and avoid a prison sentence.
However, some offenses carry mandatory sentences for which a period of probation, conditional discharge or periodic imprisonment may not be imposed.
Section 5/5-5-3 of the Criminal Code provides a list of offenses for which probation, conditional discharge or periodic imprisonment is not allowed. In such cases the law requries that the court sentence the person to nothing less than the minimum term of imprisonment for that offense.
The following offenses are included in this list:
1. First degree murder where the death penalty is not imposed;
2. Attempted first degree murder
3. Any class X felony
4. Certain drug offenses relating to trafficking or delivery of over 5 grams of cocaine, heroin or fentanyl within 1000′ of truck stops, rest areas, certain parks or schools, or other specified areas;
5. Trafficking 2500 grams or more of marijuana or criminal cannabis conspiracy;
6. Any class 2 or greater felony if the person previously had been convicted of a class 2 felony or similar offense of another jurisdiction within 10 years;
7. Residential burglary;
8. Criminal sexual assault;
9. Aggravated battery of a senior citizen;
10. Any forcible felony if related to the activities of an organized gang;
11. Vehicular hijacking;
12. A second or subsequent conviction for hate crime when the underlying offense upon which the hate crime is based is felony aggravated assault or felony mob action;
13. A second or subsequent conviction for the offnese of institutional vandalism if the damage to the property exceeds $300;
14. A class 3 felony violation of certain provisions of the Firearm Owners Identification Act;
15. Using or threatening bodily harm to an individual or that individual’s family to compel membership in or deter leaving any organization;
16. Certain offenses involving child pornography;
17. Arson involving a residence or place of worship;
18. Unlawful sale of firearms;
19. A second or subsequent violation of the Methamphetamine Control and Community Protection Act;
20. A second or subsequent offense of driving while license suspended or revoked if suspended or revoked because of a violation of reckless homicide or similar law of another state;
21. Aggravated child pornography;
22. Unlawful purchase of a firearm;
However, just because a person is charged with one of these offenses does not mean that prison is inevitable. First, one should not overlook that a charge is only an accusation; it does not mean anything at all unless proven beyond a reasonable doubt to a judge or jury.
