The Illinois Legislature has created some new rules concerning the Illinois Secretary of State’s administration of driving privileges for 2011.
First, the Legislature has provided the availability of Restricted Driving Permits in cases of driver’s license suspensions based on child support arrears. According to 625 ILCS 5/7-702, following the entry of a contempt order by a court for failing to pay child support payments or upon motion of the person owing child support, if suspended, the court may issue an order directing the Secretary of State to issue a family financial responsibility driving permit for driving between home and work, within the scope of employment or drug or alcohol treatment or medical care. If the person owing child support is unemployed, the court may issue an order for a restricted driving permit for the purpose of seeking employment. However, the permit to drive will only be valid between 8:00 a.m. and 12:00 p.m., Monday through Friday. Further, to be eligible for the permit, the person seeking it must prove that no alternative means of transportation are readily available.
Additionally, following a certification of delinquency, the Department of Healthcare and Family Services may direct the Secretary of State to issue a permit under the same conditions. To obtain a permit under these conditions the person must call the hotline at (217) 524-2936 to obtain the forms. Thereafter, the Department will approve or deny the petitions. If approved, the person must still wait for the permit from the Illinois Secretary of State.
The permit shall be subject to the same cancellation, invalidation, suspension and revocation rules in the same manner as a driver’s license. Further, a person is eligible for the permit under these conditions only if his or her driving privileges are otherwise valid, but for the child support suspension.
Additionally, the Illinois Vehicle Code now contains a provision for a Statutory Summary Revocation of driving privileges. If a person is involved in a car accident that resulted in injuries or death and is arrested for DUI, but refuses blood, breath or urine testing, that person’s driving privileges shall be summarily revoked. Thereafter, driving privileges shall be reinstated only after approved through a formal hearing with the Illinois Secretary of State. However, the revocation can be rescinded by a court. No Monitoring Device Driving Permit shall be available for driving following a revocation under this section.
The new law also provides for creation of a revocation for convictions of moving violations that result in accidents causing death. Under this law, when any moving violation is the proximate cause of the death of any person, the Illinois Secretary of State shall impose a mandatory revocation. However, following such revocation, the driver may seek to have the revocation terminated or the length of revocation reduced by requesting an administrative hearing with the Secretary of State prior to the projected driver’s license application eligibility date.
