The above client had not had a driver’s license for more than twenty years. With the help of Harter & Schottland the client had full reinstatement of privileges within three months of hiring the firm. While the client had begun the process many times, the confusion and lack of correct information quickly led to abandoned efforts. Indeed, the issue of driving privileges is daunting and complex.
In the state of Illinois driving privileges can be revoked, suspended or stopped. A revocation is the most serious, and means that you cannot regain your driving privileges unless you have either a formal or informal hearing. Some traffic or criminal charges lead to a mandatory revocation, such as a conviction on a DUI. However, there are also times where the Secretary of State revokes a person at its discretion, such as being a repeat offender of certain violations. Being stopped while driving on a revoked license will, at a minimum, lead to an arrest and a hefty fine. When based on a DUI, the penalties are severe and escalate sharply, leading to felony offenses and substantial time in prison. However, even if the revocation is not based on a DUI, your third stop for driving on a revoked license requires 30 days in jail, even if it remains a misdemeanor.
The suspension carries very similar penalties to a revocation but does not require a hearing to clear up. Rather, there are actions the person must take to remove the suspension. There are many, many causes of a suspension. Understanding what caused the suspension and how to clear it up can get complicated. A person can be suspended for multiple reasons that can include fees to the Secretary of State, compliance with a court order, or the presentation of documents. Lastly, the Secretary of State can impose a “stop” against your privileges. As long as your license is valid, there are no issues.
