Getting in a car accident is traumatic–even if there aren’t any injuries. However, when there are injuries, it also becomes confusing, intimidating, and, perhaps, frightening. Immediately after an accident occurs, you should call the police. A police report is important to documenting what happened and necessary for any claim with an insurance company. If there are injuries, let the officer know what you are feeling so that he can note it in the report. It is a good idea request an ambulance or go directly to the hospital on your own after the accident is processed.
Now, who is going to pay for all of this? This is one of the biggest reasons that getting in an accident is so complicated. Illinois law now requires all vehicles to be insured in the following minimum amounts:
$20,000 – injury or death of one person in an accident
$40,000 – injury or death of more than one person in an accident
$15,000 – damage to property of another person
In theory, every car on the road should have insurance at those minimum levels. However, this is not the case, and even if it were true, if you’ve been to the hospital or repaired your car lately, you know that these minimums will not go very far.
If you are injured as a result of someone else’s behavior, this type of case is called “personal injury” and it is a civil case that can be brought to recover damages, pain and suffering, loss of normal life, medical bills, and more. These lawsuits, though, do not seek to get John Doe’s home equity or 401 (k) to pay for your medical bills and other damages. Rather, recovery is sought from different sources of insurance. This is where a knowledgeable attorney can really make a difference. An attorney can help look for insurance you may not even be aware could cover the accident.
Another problem is that even if there is no dispute that you were not at fault and there is sufficient insurance coverage, the other insurance company will not pay hospital bills until you settle the case fully. Unfortunately, if you need continuing treatment, it could be months before those bills are paid, which means you run the risk of getting sent to collections unless you find another means to pay for those bills. If you have private group insurance, medicare, medicaid, or med-pay through your own vehicle insurance, they will pay some or all of your medical bills. These insurers can then be reimbursed when you settle your case or finish your treatment.
