The judge determines if the violation occurred and, if so, what the penalty is. However, the judge has nothing to do with the driver’s privilege to drive. A court cannot take away a driver’s license or grant driving privileges. Instead, the circuit clerk’s office reports court outcomes to the Illinois Secretary of State.

The Secretary of State controls a person’s legal ability to drive. The Illinois legislature provides the Secretary of State with a list of rules governing when a license must be suspended, revoked, or canceled. This list is extensive. Accordingly, it is essential for drivers to know ahead of time whether the ticket they receive could result in a loss of driving privileges. Judges cannot provide legal advice in court. Many drivers plead guilty thinking they will just pay a fine and move on, but sometimes this plea sets them up for a license suspension.
Furthermore, it is not just driving offenses that can cause a suspension. For example, if someone under 21 is found guilty of consuming or possessing alcohol, their license will be suspended—even if no car was involved. Other criminal offenses, even those unrelated to traffic violations, can also result in a suspension.
