Learn Illinois rules for construction zones: higher fines, cell phone bans, and stricter speed laws.

It’s hard to keep up with traffic laws. Once we figure out one set, lawmakers add to them or change them. One area that has recently changed is the law on driving in a construction zone.

In general, drivers know that construction zones often come with slower speed limits. But there are other important details. A recent change expanded the definition of a construction zone. Now, the zone begins as soon as the sign announces you are approaching a construction speed zone. A construction zone remains in effect even if the speed does not change (625 ILCS 5/11-605.1(c)).

Speeding through a construction zone is a petty but costly offense. The minimum fine for a first violation is $375. For a second or subsequent violation, the fine jumps to at least $1,000. If the second or later violation occurs within two years of the prior one, your driver’s license will be suspended for a minimum of 90 days.

In addition to speed restrictions, construction zones also have stricter cell phone rules. Drivers cannot use a handheld phone in a construction zone. The only exceptions are using the phone by voice, through a headset, or activating/deactivating it with a single button press.

For ordinary speeding tickets, a common defense is to challenge radar use. Under 625 ILCS 5/11-602, electronic speed-detecting devices cannot be used within 500 feet beyond a speed-limit sign. If they are, the evidence is inadmissible. But the construction zone statute specifically eliminates this defense.

That doesn’t mean there are no defenses. Given the steep fines and license consequences, it is important to consult an attorney if you receive a construction zone speeding ticket.
