Medicinal Marijuana Moves Forward

Posted on: August 17th, 2014 by Harter Schottland

While it’s been a long wait, the Joint Committee on Administrative Rules finally approved the proposed rules for the medical cannabis pilot program on Tuesday, July 15. However, this does not mean that those with qualifying diseases can go out today and get medical marijuana. Under the proposed rules, qualifying patients whose last name begins with the letters A through L, and their designated caregivers, have to wait until September 01, 2014 to apply for a registry identification card and the registrations period lasts until October 31, 2014. As for potential qualifying patients with the last names M through Z, they must wait until November 1, 2014 to apply for the card. The registration period for this group lasts until December 31, 2014. Beginning on January 01, 2015, applications for the card will be accepted year-round.

The applications have also finally been made available. A link for the application is available on the Medical Cannabis Pilot Program state site. The Department has 30 days to review each application and then 15 days after approval to issue a registry card. The Department is to send notifications of denial to applications that are incomplete or non-qualifying. If more than 35 days have passed since a you submitted an application, only then can you request a status by email.

The involved agencies (Department of agriculture, Department of Revenue, Department of Public Health, and Department of Financial and Professional Responsibility) intend to continue to accept questions and then to post them on a “Frequently Asked Questions” section on Click here for a direct link. There are certain to be quite a few questions and more added regularly. For the most recent version of the rules affecting a potential qualifying patient, click here.
